Introduction to the User Agreement:

(Momacha) welcomes you and informs you that you will find below the terms and conditions regulating your use of (Momacha) and all legal effects resulting from your use of (Momacha) services over the Internet via this electronic platform, as the use of (Momacha) by any person, whether a consumer of a (Momacha) service or product or otherwise, is an approval and acceptance from him and he is fully qualified according to Sharia, system and law for all the articles and provisions of this agreement and it is an affirmation of your commitment to its regulations and what is mentioned therein, and this agreement applies to all types of dealings between (the consumer) and (Momacha). This agreement is considered valid and effective once you approve it and start registering with (Momacha) in accordance with Article 10 of the Saudi Electronic Transactions System.

Article One - Introduction and Definitions:

The above preamble is an integral part of this Agreement, and below you will find the meanings and definitions of the key terms used in this Agreement:

1- (Momcha): This definition includes all forms of (Momcha) on the Internet, whether it is an electronic application, a website on the Internet, or a commercial store.

2- (Consumer): The person who deals in e-commerce with the desire to obtain the products or services provided by (Momacha) through its electronic platform.

3- (Agreement): This term means the terms and conditions of this agreement, which govern and regulate the relationship between the parties to this agreement.

Article Two - Legal Capacity of the Consumer:

1- The (consumer) acknowledges that he has the legal capacity recognized by Sharia and the system to deal with (Momacha), or that he is not less than eighteen years old.

2- The (consumer) agrees that if he violates this article, he will bear the consequences of this violation before third parties.

Article Three - Nature of the Obligation:

1- Momacha's commitment to consumers is to provide the service or product.

2- (Momacha) may provide other services such as after-sales services or other related services, depending on the nature and type of service or product requested by the (consumer).

Article Four - Use Controls:

1- The (consumer) is committed to using the electronic platform of (Momacha) in accordance with public morals and the regulations in force in the Kingdom of Saudi Arabia.

2- The (consumer) undertakes, when purchasing a service or product from (Momacha), not to use this service or product in a manner that violates public morals and the regulations in force in the Kingdom of Saudi Arabia.

Article Five - Accounts and Registration Obligations:

Upon applying to join the membership of (Momacha) as a user, you are obligated to disclose specific information and choose a user name and a secret password to be used when accessing the (Momacha) services. Thus, you have agreed to:

1- You are responsible for maintaining the confidentiality of your account information and password, and you agree to notify (MoMacha) immediately of any unauthorized use of your account information with (MoMacha) or any other breach of your confidential information.

2- (Momacha) will not be responsible in any way for any loss that may be incurred by you directly or indirectly, morally or materially, as a result of disclosing the information of the (consumer) name or password.

3- You are committed to using your account or membership with (Momacha) yourself, as you are fully responsible for it, and if someone else uses it, this is evidence that you have authorized him to use (Momacha) in your name and on your behalf.

4- You agree that when using (Momacha), you will use it with all seriousness and honesty.

5- You undertake to disclose true, correct, current, complete and legal information about yourself as required during registration with (Momacha) and you undertake to update your data in the event of a change in reality or in the event of a need to do so.

6- (Momacha) is committed to treating your personal information and contact addresses with complete confidentiality.

7- If (Momacha) finds that you have disclosed information that is false, incorrect, outdated, incomplete, illegal, or in violation of the User Agreement, (Momacha) has the right to suspend, freeze, or cancel your membership or account on the platform, without prejudice to (Momacha’s) other rights and legitimate means of recovering its rights and protecting the rest of the (consumers).

8- In the event of non-compliance with any of the above, the management of (Momacha) has the right to suspend or cancel your account or membership or block you from accessing (Momacha) services again.

Article Six - Electronic Communications and Official Means of Communication:

1- The parties to this agreement agree that communication will be via email and the number registered on the platform.

2- The (consumer) agrees that all agreements, advertisements, data and other communications provided to him electronically are equivalent to their written counterparts, and are an independent argument, in meeting the regulatory and legal requirements.

3- The (consumer) agrees to the possibility of communicating with him and informing him of any provisions related to this agreement or related to dealing with him by the (Momacha) administration broadcasting general messages to all (consumers) or to specific users of (Momacha).

Article Seven - Amendments to the User Agreement and Fees:

1- In the event that any article or clause contained in this agreement is cancelled or that any article or clause contained in this agreement is no longer valid, such a matter does not cancel the validity of the remaining articles, clauses, rules and provisions contained in this agreement and they remain in effect until further notice from the management of (Momacha).

2- This agreement - which is amended from time to time as appropriate - constitutes the mechanism of work, understanding and agreement between (the consumer) and (Momacha).

3- (Momacha) may impose fees on some (consumers) depending on the offers, products or services they request or the fees or taxes imposed by the state on the nature of the product or service.

4- (Momacha) reserves the right to add, increase, reduce or deduct any fees or expenses under the articles, terms and provisions of the User Agreement, for any of the (consumers) regardless of the reason for their registration.

Article Eight - Payment and Settlement Services:

1- (Momacha) provides, through its partners, a payment and settlement system, which can be done entirely online through the payment options available on (Momacha) or through any payment method provided by (Momacha) from time to time.

2- (Momacha) is committed to setting the price of the service or product that it displays in its store according to the recognized market value.

3- (Momacha) is committed to providing invoices, receipts and receipts for all amounts and profits generated in his store, and is committed to giving the (consumer) an invoice for his purchase of a service or product.

4- (Momacha) is committed to providing the generally accepted accounting specifications in its online store, in application of the provisions of this agreement, and for the legal, economic, commercial and organizational interests in this organization.

Article Nine - Intellectual Property:

1- The intellectual property rights of (Momacha) are rights owned by (Momacha) in full, whether they were owned by them before or after the establishment of this electronic platform.

2- The (consumer) respects the intellectual property rights of (MoMacha), which include the name (MoMacha) itself, and the words, logos and other symbols of (MoMacha) or displayed to him, as every right that follows the name (MoMacha) are rights that are fully owned by (MoMacha) intellectual property.

Article 10 - Responsibility of (Momacha):

1- (Momacha) is committed to conducting its business through this electronic platform in a regular manner and in accordance with the regulations in force in the Kingdom of Saudi Arabia, and in accordance with the provisions of this agreement.

2- (Momacha) shall not be liable for any claims arising from errors or negligence, whether directly, indirectly, incidentally, or by (the consumer) or by a third party such as shipping companies.

3- (Momacha), its employees, owners and representatives are committed to ensuring that the product or service is sound, legitimate and authorized in accordance with the laws and regulations of the Kingdom of Saudi Arabia and is used for legitimate purposes.

Article Eleven - Restriction of Access or Membership:

Momacha may suspend or cancel the Consumer's membership or restrict the Consumer's access to the Platform Services at any time without notice and for any reason, without limitation.

Article Twelve - Applicable law or regulation:

This User Agreement is governed by and formulated in accordance with the laws, regulations and legislation in force and in effect in the Kingdom of Saudi Arabia, and is fully and completely subject to the regulations in force with the authorities in the Kingdom of Saudi Arabia.

Article Thirteen - General Provisions:

In the event that any provision or clause contained in this User Agreement is cancelled or that any provision or clause contained in this User Agreement is no longer valid, such matter shall not cancel the validity of the remaining provisions, clauses and terms contained in this User Agreement and they shall remain valid until further notice from the management of (Momacha).

This User Agreement - which may be amended from time to time as appropriate - constitutes the User Agreement, mechanism of work, understanding, agreement and contract between (Momacha) and (the Consumer), and both parties to this Agreement agree to take into consideration the following:

1- The Arabic language is the language used when interpreting the provisions of this agreement, or when translating it into another language.

2- All prices displayed for (Momacha) services or products may be modified from time to time.

3- The promotional or marketing offers that (Momachha) may put in place are temporary offers, as (Momachha) has the right to modify or stop these promotional or marketing offers at any time.

4- The parties to this agreement are committed to dealing with each other in a manner that does not violate the Sharia rules, regulations and laws in force related to the nature of the dealings between (Momacha) and (the consumer).

5- This User Agreement shall not be cancelled except by a decision issued by the management of (Momacha).
